SYSTEM TERMS OF USE

Welcome to the thegoqubestore.com website, which includes the QubeVision system (collectively, the "System"). The System is owned and operated by QUBEVISION LTD. ("QUBEVISION," "we," "us," or "our").By accessing or using the System or any services offered through the System, you confirm that you have read, understood, and agree to be bound by these Terms of Use(the "Terms"). Please read these Terms carefully before using the System.

IF YOU DO NOT AGREE TO THE FULL EXTENT OF THESE TERMS, OR IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS, PLEASE DO NOT USE THE SYSTEM OR ANY OF THE SERVICES OFFERED BY THE SYSTEM.

QUBEVISION reserves the right, in its sole discretion, to amend these Terms by publishing updated Terms through the System or otherwise making them available to you. We encourage you to review these Terms periodically for updates.Your continued use of the System after updated Terms are published constitutes your acceptance of the updated Terms, to the extent permitted by applicable law.

References in these Terms to any gender are for convenience only and shall be deemed to include all genders. References to the singular include the plural, and references to the plural include the singular, unless the context requires otherwise.

These Terms apply to any individual who uses the System, whether personally or on behalf of an organization.

The System is an immersive, AI-powered concierge and travel-experience platform deployed in hotels, airports, and major tourist hubs. It combines conversational AI, large-format immersive screens, and intuitive interaction design to guide travelers through personalized recommendations and curated experiences.

QUBEVISION grants you a limited, revocable, non-exclusive, non-transferable, personal license to access and use the System, solely in accordance with these Terms.

You are not required to open an account or provide personal information in order to use the System, except for information expressly requested by QUBEVISION for operating the System, providing the requested services, complying with applicable law, or as otherwise described in the Privacy Policy. Use of the System is currently free of charge. QUBEVISION may introduce fees or paid features in the future, provided that any such fees will apply only after prior notice and, where required by applicable law, your consent.

The System is not intended for use by minors under the age of 16 or by users who have been suspended or removed by QUBEVISION. If you are between the ages of 16 and 18, you may use the System only with the involvement and consent of your parent or legal guardian, who should review and agree to these Terms and the Privacy Policy.You may not provide personal information about family members or other individuals, including minors, unless you have the authority and lawful basis to do so.

You represent and warrant that all information you provide to QUBEVISION is true, accurate, complete, and current, and you agree to update such information as necessary to maintain its accuracy, correctness, and completeness.

Information and materials that you provide in connection with your use of the System, as well as information generated through your use of the System,may be stored on QUBEVISION’s systems.Information collected or processed in connection with your use of the System, including information about you or your organization, will be handled in accordance with QUBEVISION’s Privacy Policy, available at: https://thegoqubestore.com.

Due to the nature of the System and its use of artificial intelligence, outputs that you receive may or may not be unique and may be similar to outputs provided to other users or to users within your organization.

QUBEVISION processes content and information provided through the System as necessary to provide, operate, maintain, and secure the System, and the services provided to you and to comply with applicable law. QUBEVISION will not use such content or information to train or improve its models unless you have given separate, specific, opt-in consent for that purpose, which you may withdraw at any time. Any such consent will state which data is used, for how long it is retained, and whether it is transferred outside Israel. This is addressed further in the Privacy Policy.

You must not provide or submitsensitive personal information, confidential information, trade secrets, payment card data, health information, government identification numbers, passwords, authentication credentials, information about children, or any other high-risk data. You are solely responsible for ensuring that any information or materials you provide comply with applicable law and do not infringe, misappropriate, or violate any third-party rights.

Any feedback, suggestions, ideas, comments, improvements, or other input that you provide regarding the System may be used by QUBEVISION without restriction or compensation to you, and you hereby grant QUBEVISION a perpetual, irrevocable, worldwide, royalty-free license to use such feedback for any purpose.

Please note that AI and machine learning are rapidly evolving fields. We are constantly working to make the System more accurate, reliable, safe, and beneficial. However, some outputs generated by the System may not accurately reflect real people, places, or facts. You acknowledge and agree that: (i) the outputs, work products, and analyses generated by the System may not always be accurate and should not be relied upon as a sole source of truth, factual information, or professional advice; (ii) you should evaluate the accuracy and appropriateness of outputs with the assistance of a qualified expert before using or sharing them; (iii) you shall not use information relating to an individual for any purpose that could have a legal or material impact on that individual, you, or your organization; and (iv) the System may provide incomplete, incorrect, or offensive data or analysis that does not represent the facts or QUBEVISION’s views.

Your privacy is very important to us at QUBEVISION. To better protect your rights we have provided the QUBEVISION Privacy Policy (https://thegoqubestore.com) to explain our privacy practices in detail. We invite you to review our Privacy Policy, which governs your visit to the System. All information we obtain about You in connection with your use of the System is subject to our Privacy Policy.

Please note that your use of the System may be recorded by QUBEVISION using a camera positioned to the side of the System for learning, evaluation, and improvement purposes. Any such recordings will be collected, used, stored, and protected in accordance with applicable law and QUBEVISION’s Privacy Policy.

To ensure that use of the System is lawful, appropriate, and consistent with these Terms, you and all other users must not:

  1. (i)
    use the System for any illegal purpose or for any purpose other than for the purposes for which it is intended;
  2. (ii)
    sell or make commercial use of any materials contained in the System, unless permitted by QUBEVISION. The System is intended only for use by you, either as an individual or on behalf of your organization, and not by any third party on your behalf.
  3. (iii)
    use the System in violation of any law, contractual restrictions or other third party rights;
  4. (iv)
    intentionally interfere with or damage operation of the System or any user’s enjoyment of the System.
  5. (v)
    upload, post, email, transmit, or otherwise make available any content that: (a) you do not own or have the right to disclose or make available under any law, contract, fiduciary duty, confidentiality obligation, or third-party proprietary right; (b) constitutes unauthorized advertising, including "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation; or (c) contains software viruses, adware, spyware, worms, or other malicious code.
  6. (vi)
    except as expressly permitted in these Terms or with QUBEVISION’s prior written consent: (i) use, modify, or integrate the System into other software, or create derivative works from any part of the System; (ii) sell, license, sublicense, lease, assign, transfer, pledge, or share your rights under these Terms with any other person; (iii) copy, distribute, or reproduce the System for the benefit of third parties; (iv) disclose the results of the System’s performance or use those results to develop a competing system; or (v) modify, disassemble, decompile, reverse engineer, update, improve, or attempt to discover the source code of the System. (iv) share credentials, bypass security measures, probe, scan, or test vulnerabilities, access or attempt to access any non-public area of the System, interfere with authentication or access-control mechanisms, or use bots, crawlers, scripts, or other automated means to access, monitor, copy, scrape, or extract data from the System except as expressly authorized by QUBEVISION in writing.
  7. (vii)
    use the System to provide passwords or personal details about others; harass or impersonate others; advertise or promote commercial sales; promote political propaganda, candidates, or parties in elections; use offensive language; collect details about others; copy information or advertisements from the System and publish or present them elsewhere for commercial purposes or in a manner that may harm QUBEVISION’s business; overload the System with information; promote artificial content; publish false materials or scams; or publish unauthorized links.
  8. (viii)
    attempt to collect information from the System, including through technological means, automated tools, scraping, scanning, copying, retrieving, or mining information; make or cause any changes to the System; or interfere with the System or its source code.
  9. (ix)
    use the System in a manner that damages, infringes, or violates any contractual right, proprietary right, copyright, moral right, quasi-proprietary right, duty of care or trust, trade secret, trademark, patent, or similar right.
  10. i.
    use, access, export, re-export, transfer, or make available the System or any related technology in violation of applicable export-control, sanctions, anti-terrorism, anti-corruption, or anti-money-laundering laws or regulations.

QUBEVISION may suspend, restrict, or terminate your access to the System, in whole or in part,at any time and without liability, subject to applicable law, if QUBEVISION reasonably believes that you have violated these Terms, created legal, operational, privacy, security, or reputational risk, misused the System, infringed third-party rights, or acted in a manner that may harm QUBEVISION, the System, other users, or any third party.

QUBEVISION may modify, update, suspend, discontinue, replace, limit, or remove the System or any feature, functionality, content, or service at any time, with or without notice, subject to applicable law. Certain features may be beta, experimental, incomplete, unavailable, changed, suspended, or discontinued, and QUBEVISION makes no commitment to maintain or continue any particular feature, functionality, or service.

When you visit the System or send emails to QUBEVISION, you are communicating with QUBEVISION electronically. You consent to receive communications from QUBEVISION electronically. You agree that all agreements, notices, disclosures, and other communications that QUBEVISION provides electronically satisfy any legal requirement that such communications be in writing. This section does not constitute consent to receive advertising material within the meaning of section 30A of the Communications (Telecommunications and Broadcasts) Law, 5742-1982.

The System may include or rely on third-party technologies, systems, services, content, websites, or resources, including OpenAI or other AI-service providers. Such third-party technologies, systems, services, content, websites, and resources are provided for your convenience only. QUBEVISION does not control, endorse, or assume responsibility for any third party or for any information, materials, products, or services made available by third parties. Your access to and use of third-party technologies, systems, services, content, websites, and resources is solely at your own risk and may be subject to the third party’s terms of use, privacy policy, and other applicable terms, which you are responsible for reviewing and complying with.

Your use of third-party technologies, systems, services, content, websites, and resources may also be subject to third-party acceptable-use policies, AI-use restrictions, privacy policies, booking terms, cancellation policies, payment terms, and other terms imposed by those third parties. QUBEVISION is not responsible for the availability, accuracy, quality, pricing, performance, cancellation, refund, safety, legality, or suitability of any third-party product, service, venue, hotel, restaurant, attraction, tour, transportation service, booking provider, or travel-related provider.

All content included in or made available through the System, including designs, drawings, logos, brand names, text, graphics, button icons, images, digital downloads, data compilations, page headers, scripts, service names, software, technology, user interfaces, and all associated copyrights, trademarks, service marks, patents, trade secrets, and other proprietary rights, is owned by QUBEVISION or its licensors and is protected by applicable intellectual property laws. Nothing in these Terms transfers to you any ownership right or interest in the System or related content, technology, or materials. You receive only a limited right to use the System in accordance with these Terms.

QUBEVISION retains all rights in and to the System, its underlying technology, models, software, processes, know-how, and improvements.

THE SERVICES INCLUDED IN THE SYSTEM ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, QUBEVISION EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, AVAILABILITY, SECURITY, AND NON-INFRINGEMENT.

QUBEVISION makes no warranty that: (i) the System will meet your requirements; (ii) the System will be uninterrupted, timely, secure, or error-free; (iii) the results obtained from use of the System will be accurate or reliable; or (iv) the quality of any material or result obtained through the System will meet your expectations.

Any use of the System is at your own discretion and risk, and you are solely responsible for any damage or loss arising from such use.

No result, advice, or information, whether oral or written, obtained by you through the System, QUBEVISION, or any third party shall create any warranty by QUBEVISION that is not expressly stated in these Terms.

QUBEVISION is not responsible for ensuring that any information, report, analysis, summary, recommendation, or other output produced through use of the System (collectively, "Work Products") will be accurate, complete, suitable, lawful, or satisfactory to you. Any recommendation or output generated by the System is created by AI and may not be reviewed or examined by QUBEVISION. QUBEVISION shall have no liability for any recommendation, output, or information provided by or through the System, to the fullest extent permitted by applicable law.

QUBEVISION is not a travel agent, travel organizer, tour operator, carrier, hotel, booking agent, or provider of travel services. Your use of the System does not create any customer, agency, fiduciary, advisory, or travel-agency relationship between you and QUBEVISION. The System does not replace advice from qualified travel, legal, safety, medical, or other professional experts, and you are solely responsible for consulting any third party you choose before making travel or other decisions.

Travel-related information, including information regarding visas, entry requirements, health requirements, safety conditions, weather, transportation, prices, availability, opening hours, accessibility, reservations, and booking terms, may change frequently and may be incomplete, inaccurate, delayed, or unavailable. You are solely responsible for verifying all travel-related information directly with official sources, service providers, and qualified professionals before making or relying on any travel decision.

The System is not designed or intended for emergency use or for decisions involving health, medical treatment, legal rights, financial matters, safety, border entry, visa eligibility, transportation safety, or other high-risk matters. You must not rely on the System as the sole basis for any decision that may affect the rights, interests, health, safety, financial position, legal status, travel arrangements, or material opportunities of any person.

Any information and materials that you choose to share with QUBEVISION as part of your use of the System are provided voluntarily. You acknowledge that you are not required to provide such information or materials as a condition of using the System.

QUBEVISION shall not be responsible for the content or nature of any information that you provide or receive as part of using the System.

Any Work Products that you receive as part of your use of the System do not constitute advice or a solicitation to perform or refrain from performing any action. Any conclusion you reach, action you take, or action you choose to avoid is your sole responsibility.

You acknowledge that the System uses AI technology and that the Work Products delivered to you through the System are not directly controlled by QUBEVISION. QUBEVISION does not author such Work Products, and you waive any claims, suits, or demands against QUBEVISION in connection with them, to the fullest extent permitted by applicable law.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, QUBEVISION'S LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU EXPRESSLY UNDERSTAND AND AGREE THAT QUBEVISION SHALL NOT BE LIABLE FOR ANY INDIRECT,INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, INABILITY TO USE, DATA, MATERIALS, BUSINESS INTERRUPTION, REPUTATION, OR OTHER INTANGIBLE LOSSES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF QUBEVISION HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, QUBEVISION’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTIONSHALL NOT EXCEED US$100.

Nothing in these Terms shall exclude, restrict, or limit any liability or right that cannot be excluded, restricted, or limited under applicable law, including any non-waivable consumer rights under the Consumer Protection Law, 5741-1981 and the Protection of Privacy Law, 5741-1981. The exclusions, disclaimers, and limitations in these Terms apply only to the fullest extent permitted by applicable law.

You agree to indemnify, defend, and hold harmless QUBEVISION, its directors, officers, employees, contractors, licensors, service providers, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising out of or relating to your use of the System, your breach of these Terms, your violation of applicable law, your infringement or misappropriation of third-party rights, or any information, materials, or content that you submit, transmit, or otherwise make available through the System. Notwithstanding the foregoing, this indemnity applies only to claims arising from your unlawful use of the System or from content you knowingly submitted, and does not apply to any claim arising from an act or omission of QUBEVISION. QUBEVISION will notify you promptly of any claim for which indemnity is sought, and you may participate in the defense.

QUBEVISION shall not be liable for any delay, failure, interruption, error, loss, or damage caused by events beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, epidemics, pandemics, government actions, power failures, internet or telecommunications failures,cyber attacks on third-party infrastructure, failures of third-party providers, or other events beyond QUBEVISION’s reasonable control. Nothing in this section derogates from QUBEVISION’s obligations under the Protection of Privacy Law and the regulations made under it, including its reporting obligations in the event of a security incident.

To the fullest extent permitted by applicable law, any claim or cause of action arising out of or relating to your use of the System, these Terms, or the Privacy Policy (https://thegoqubestore.com) must be filed within six (6) months after the claim or cause of action arose, or it will be permanently barred.

If any provision of these Terms is held to be unlawful, void, or unenforceable for any reason, the remaining provisions shall not be affected and shall remain valid and enforceable to the maximum extent permitted by law. You may not transfer or assign any of your rights or obligations under these Terms, and any attempt to do so will be null and void. These Terms, together with the System Privacy Policy (https://thegoqubestore.com), constitute the entire agreement and understanding between QUBEVISION and you concerning the subject matter hereof and supersede all prior agreements and understandings of the parties with respect thereto. QUBEVISION’s failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if made in writing and signed by QUBEVISION. These Terms and all matters relating to your access to or use of the System shall be governed by and construed in accordance with the laws of Israel, without regard to conflict-of-laws principles. Any dispute, claim, or controversy arising out of or relating to these Terms, the System, or the services provided through the System shall be subject to the exclusive jurisdiction of the competent courts located in Tel Aviv-Jaffa, Israel, unless applicable law requires otherwise.

Legal notices to QUBEVISION must be sent to inbarm@qubevision.ai or ShalomM@qubevision.ai, or to any other address designated by QUBEVISION for legal notices. QUBEVISION may provide notices to you electronically through the System, by email, or by any other method permitted by applicable law.Notices will be deemed received when delivered, sent, posted, or otherwise made available, unless applicable law requires otherwise.
